These terms and conditions apply to your use of the website as a consumer and not where you are acting in the course of your business. For purchases related to a business, please contact us for our separate business terms and conditions.
1. Key Information
2. Making a purchase
Making a purchase means you will enter into a contract with us so please ensure you follow the steps below in order to conclude the contract.
STEP 1 Read and understand our terms and conditions.
You are responsible for reading the terms and conditions on our website carefully and for asking any questions seeking clarification before you make your purchase.
STEP 2 Read the information on the website.
Our website contains information about our goods which you will need to know before you make your purchase. This includes descriptions of our goods, specifications, current prices (including VAT where applicable), and our delivery and returns policies.
The information about the goods on our website constitutes an "invitation to treat" and is not a contractual offer from us which you may accept. This means that we reserve the right to correct any errors in that information without liability to you. It also means that in no circumstances will we be contractually bound to supply you with goods on the basis of any incorrect information, even if that information is repeated in your order.
STEP 3 Choose the goods you wish to purchase
You can choose the goods you wish to purchase by entering the quantity of rugs required and clicking the "Add To Basket" button. This will direct you to your shopping basket and you can also view the contents of your shopping basket at any time by clicking the "Shopping Basket" menu item. The "Shopping Basket" screen shows your currently chosen goods by way of an image, product name, quantity, price and current price subtotal. You can change the goods in your basket by removing any items via the trash can image or by changing the quantities then clicking "update".
STEP 4 Pay for goods
We must receive payment in full for any goods before they are despatched. To purchase the goods in your shopping basket and complete your order using our secure online payments system, click the "Checkout" button on the "Shopping Basket" screen. You will be prompted to enter your email address and password if you have already registered with our site, or to create an account if you haven't already done so. You will then be taken to our secure payment processing system to complete your order.
You can pay online using any major debit or credit card (Visa, Visa Debit, MasterCard, Maestro, Solo) via Worldpay, the well-known and widely trusted secure online payment system. We don't ever see your card details if they are provided in this way.
If you have your own PayPal Account, you can also use this as a method of payment.
You will be prompted to provide the information we need to enable us to process your order, particularly your payment details and the address for delivery. You are responsible for providing us with the correct information to process your order.
Alternatively, you can place your order and pay over the phone at the same time, using any major debit or credit card (Visa, Visa Debit, MasterCard, Maestro, Solo), by calling us on 0151 648 7714 instead of proceeding to Checkout.
STEP 5 Receive email confirmation that we have accepted your order
We will send you an email confirming that we accept your order and that it is being processed. It is only at this point that we will have a binding contract between us.
Depending on your chosen method of payment, you should also receive an email from either Worldpay or PayPal advising you whether or not your debit or credit card payment or funds transfer has been authorised. This email acknowledgement relates to your payment only and is not our acceptance of your order.
We will be entitled to refuse to accept your order if in our sole discretion we consider it necessary. In particular we must receive payment of the whole of the price for the goods that you order before your order can be accepted. Whether we refuse or accept your order we will let you know as soon as possible. Once we have entered into a contract with you we shall supply you with the goods specified in your order in accordance with the terms of the contract.
3. Other information about the Contract
We can only conclude the contract with you in English and not in any other language.
The prices payable for rugs that you order as well as any applicable VAT are as set out in our website. We only accept UK pounds sterling in payment for our rugs.
B. Our rights to cancel the contract
We can cancel the contract between us if:
- the items you have ordered are out of stock or are unavailable for any other reason;
- we do not deliver to your area which means typically you have chosen a location outside of the UK; or
- any one of the items you ordered is priced incorrectly due to an error on our part or due to an error in the pricing information which our suppliers provide us with.
If we decide to cancel the contract for any of these reasons we will tell you as soon as possible via e-mail and/or telephone and provide you with a full refund. Please note that we are not obliged to offer you any additional compensation for disappointment or inconvenience suffered.
We will deliver the goods ordered by you to the shipping address you provide to us at the time you make your order. Wherever possible we will notify you of delivery with a tracking reference by email or text.
Most deliveries are usually within 5-7 working days although certain items may take 7-14 working days. We ask that you allow up to 28 days in the rare event that your rug may be temporarily out of stock. We will not be obliged to offer any additional compensation if the goods are not delivered within this time frame.
We will despatch your order as soon as possible once it has been accepted. We deliver free to UK mainland addresses* between 7.30 am and 5.30 pm Monday to Friday. Unfortunately we are unable to specify an exact time on these deliveries.
*If you live anywhere in the UK other than "Mainland UK", including the Scottish Highlands, certain Islands or Northern Ireland, your delivery cost will be calculated at checkout according to your delivery postcode. To check your delivery cost, please see our Delivery & Returns page. We are also able to deliver to the Republic of Ireland, please contact us for a quote.
Our couriers prefer a signature as proof of delivery. If there is no-one available to sign for your rug when the courier arrives, they will leave a card so that you can contact them in order to either rearrange delivery or arrange to collect your goods from the local depot. You can ask for your goods to be left safe via your order instructions, but you must take full responsibility for them once they have been left in the place you have specified.
You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
Please note that our returns policy below applies to rugs ordered from the website either online or over the phone.
You can cancel your order at any time up until your rug is despatched from our showroom. At our discretion we may charge an administration fee to cover our costs in processing your order. If you refuse to take delivery of your rug, or you do not take delivery of your rug for any other reason, and it is returned to us we will deduct the cost of the return from any refund we make.
Should any rug be unsatisfactory, you must notify us within 14 days that you intend to return it, starting from the day after delivery. The rug must be returned undamaged, in its original condition and preferably in its original packaging. We understand that packaging must be removed to inspect the rug so please take care when doing so. If you are unable to use the original packaging when returning a rug, please use similar strong, waterproof packaging. We are unable to issue a refund if rugs are damaged in transit due to poor packaging, or if they have been used, or are dirty or damaged in any other way.
You are responsible for arranging the return and the return costs (unless the rug is faulty, in which case see "Faulty Goods" below). Once we have received the rug and we are satisfied that it has been returned in the same condition as it was despatched, we will issue you with a refund of the original purchase price, less any special delivery charges you have paid for Saturday deliveries or for delivery to any Islands, Scottish Highlands, Northern Ireland or Republic of Ireland.
If the rug is returned more than 14 days from the date you notify us of its intended return, or we are not satisfied that the rug has been returned to us in the same condition as it was when despatched then no refund will be issued and the rug will remain your property. You must collect it from our showroom or arrange for its collection otherwise we will dispose of it within 28 days of its return to us.
Please use the following address for returns:
515 Pensby Road
If the rug goes missing in transit when you return it we will be unable to issue a refund so please ensure you use a courier or a Royal Mail service where proof of delivery is required and where you can insure the value of the goods against loss or damage while in transit.
In the unlikely event that your rug is faulty you must follow the procedure above but we may ask to you email a photograph of the fault first before arranging a collection.
We may then decide to arrange its collection from you on a weekday, i.e., Monday to Friday, between 7.30 am and 5.30 pm. If in our opinion the rug has a manufacturing fault we will replace it for you.
Please note the following:
When taking and editing photographs for use on our website we make every effort to accurately represent the colours of our rugs and we aid this by providing descriptions of the colours as well. Please contact us if you need any advice or clarification on colours. However, the descriptions are open to interpretation as is any such advice, while settings on your monitor can affect the onscreen display of colours. If you aren't happy with the colours when you receive your rug then you can return it by following the returns procedure above but we cannot accept any responsibility for colour misrepresentations. The rug will not be deemed faulty and we will issue you with a refund subject to the same deductions outlined above and you will be responsible for the return costs as well.
Some of our rugs have been photographed as new, soon after removing them from their packaging, and as such they can appear to have folds or other markings in the pile. These markings are entirely natural and should disappear after a short period of use.
Rug sizes are officially measured, expressed and displayed in centimetres. However, we also provide an approximate (up to 1 inch) equivalent imperial measurement for your convenience.
Note that slight variations in colour and size (up to 5cm) can occur due to the nature of the manufacturing process.
Shedding is a natural characteristic of a deep pile rug and is not deemed to be a fault. This is common on Acrylic and Wool rugs and should be taken into consideration when choosing a product.
4. Our liability to you
A. Your remedy for damaged goods
In the unlikely event that the goods we deliver are not what you ordered or are damaged / defective, or the delivery is of an incorrect quantity, please notify us immediately. We will then, at our option:
- make good any shortage or non-delivery; or
- replace any rug that following our inspection is damaged or defective; or
- refund the amount paid by you for the goods in question.
B. Limitations on our liability to you
You are responsible for observing and complying with all applicable regulations and legislation which affect your purchase and subsequent use of our goods. This includes obtaining all necessary customs, import or other permits to purchase goods from our site. Certain national laws may prohibit the importation or exportation of certain of our goods to you. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
To the extent that law permits us to do so, we exclude all our liability to you for any direct, indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem relating to the goods you buy from us, other than the remedies listed in paragraph A above.
If a court does decide we are liable to pay you compensation, that compensation will be limited to the amount paid by you for the goods in question. Please note that nothing in this section of these terms and conditions (or in any other section) is intended to limit any rights you might have as a consumer or other statutory rights that may not be excluded by law, nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence or for fraudulent misrepresentation.
5. Things you should know
A. Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
D. Third party rights
A person who is not a party to this contract has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
E. Governing law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
F. Entire agreement
